1. Acceptance of the Terms

These Terms and Conditions ("Terms") constitute a legally-binding agreement between you ("User," "you") and Producthow Labs LLC, a company incorporated and existing under the laws of the Republic of Armenia ("Company," "we," "us," or "our"), for your use of the Quffy mobile application for Apple iOS and all related services (collectively, the "App").

By downloading, installing, or using the App, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, do not install or use the App.

2. Eligibility

You must:

  • (a) be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) and
  • (b) have the legal capacity to enter into a contract.

If you access the App on behalf of an organisation, you represent that you are authorised to bind that organisation.

3. Future Changes to the Terms

We may revise these Terms to reflect new features, legal requirements, or business practices. Material changes will be announced in-App or via the e-mail associated with your Apple ID at least 14 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms.

4. Description of the Service

Quffy is a digital cessation-support tool that helps Users plan, track, and sustain efforts to quit habits such as smoking or vaping.

Important: Quffy is not a medical device and does not provide professional healthcare advice. Always consult a qualified healthcare professional before making health decisions.

5. Health & Safety Disclaimer

No Medical Advice

All content is for general motivational purposes only.

Emergency Situations

Quffy is not suitable for crisis intervention. In an emergency, call your local emergency number immediately.

Liability: We are not liable for any consequences arising from your reliance on information in the App.

6. Account Registration and Security

You agree to:

  • Provide accurate information
  • Keep your credentials confidential
  • Notify us promptly of unauthorised use

You are responsible for all activity under your account.

7. Subscriptions, Trials & Payments

Subscription Features

Some features require a paid subscription processed via Apple In-App Purchase. Prices, billing cycles, and trial periods are displayed in the App.

Free Trials

Free trials convert to a paid plan unless cancelled at least 24 hours before the trial ends.

Cancellations & Refunds

Cancellations & refunds are managed in your Apple ID settings and processed by Apple in accordance with App Store policy.

Pricing

Prices may be shown in Armenian drams (AMD) or your local App Store currency; applicable taxes may apply.

8. Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or hack the App
  • Upload viruses or malicious code
  • Infringe intellectual-property or privacy rights
  • Harass, threaten, or harm others
  • Violate any applicable laws, including Armenian personal-data-protection law

9. Intellectual Property

All trademarks, logos, content, and software in the App are the property of Producthow Labs LLC or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

10. User-Generated Content

You retain ownership of content you submit (e.g., journal entries) but grant us a worldwide, royalty-free licence to host, store, back up, and process that data solely to provide and improve the App.

11. Privacy & Data Protection

We process personal data in accordance with:

  • The Law of the Republic of Armenia "On Protection of Personal Data"
  • Where applicable, the EU GDPR

Special Provisions

  • For users under 16, consent must be provided by a parent or legal guardian
  • Cross-border transfers rely on appropriate safeguards such as Standard Contractual Clauses

12. Third-Party Services

The App may integrate with third-party platforms (e.g., cloud backup, analytics, HealthKit). Your use of those services is governed by their separate terms; we are not responsible for their content or practices.

13. Apple-Specific Terms

These Terms are between you and Producthow Labs LLC, not Apple Inc.

Apple's Role:

  • Apple bears no responsibility for maintenance or support of the App
  • To the maximum extent permitted by law, Apple provides no warranty and assumes no liability for the App
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

14. HealthKit / Apple Health (Optional)

If you connect Quffy to HealthKit / Apple Health:

Data Access

  • Data is accessed or written only with your explicit permission
  • We do not use HealthKit data for advertising
  • You can revoke access at any time in iOS Settings › Health

15. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE." We disclaim all express or implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

16. Limitation of Liability

To the fullest extent permitted by Armenian law, Producthow Labs LLC, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of—or inability to use—the App.

Maximum Liability: Our total aggregate liability will not exceed the greater of:

  • (a) AMD 25,000 or
  • (b) the amount you paid us for the App in the 12 months preceding the claim

17. Indemnification

You agree to indemnify and hold harmless Producthow Labs LLC and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of the App.

18. Governing Law & Dispute Resolution

Governing Law

These Terms are governed by the laws of the Republic of Armenia.

Arbitration

Any dispute shall be finally resolved by arbitration in Yerevan under:

  • The Law of the Republic of Armenia "On Commercial Arbitration"
  • The Rules of the Arbitration Court adjacent to the Chamber of Commerce and Industry of Armenia

Arbitration Details

  • Tribunal: One arbitrator
  • Language: English
  • Seat: Yerevan

Waiver: You and we waive the right to a jury trial and, to the extent permitted by law, to participate in class actions.

19. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force, and an enforceable term will be substituted that reflects the original intent as closely as possible.

20. Assignment

  • You: May not assign these Terms without our prior written consent
  • We: May assign them in connection with a merger, acquisition, or sale of assets

21. Entire Agreement

These Terms, together with our Privacy Policy and any in-App guidelines, constitute the entire agreement between you and us regarding Quffy and supersede all prior agreements or understandings.
